Mike & Jay open the show with a discussion of the recent ruling mandating that the Trump administration restart the DACA program. While the Supreme Court has ruled on DACA, it hasn’t ruled on the merits of the case – only on the Trump administration’s method of ending it. Both Mike & Jay think that a legislative fix would be preferable to any executive action and see DACA as executive overreach.
Next is a look at the ongoing COVID stimulus talks. Jay believes there’s a real possibility of a deal largely along Republican lines, whereas Mike feels that Democrats have compromised more than Republicans and that we might not see a major relief package until after Joe Biden becomes president.
After that they turn to President Trump’s continuing election challenges and how lucrative they’ve been for his post-presidency political action committee. The president’s claims of massive election fraud have complicated things for Republicans in the Georgia US Senate runoff elections, though Jay doesn’t believe that calls from some Trump supporters to boycott the election will have a significant effect. Mike agrees, but points out that in a close election, even a few election boycotters might tilt the races in favor of the Democrats.
They close the show with a discussion of Attorney General William Barr. Early in the week he announced that the Department of Justice had found no evidence of fraud significant enough to overturn the results of the presidential election, which President Trump vigorously disputes. Barr also named US Attorney John Durham as special counsel in the investigation of the ‘Russia conspiracy’ investigators. While Mike questions the legal legitimacy of the appointment, both Jay and Mike believe the Biden administration won’t make any move to dismiss the special counsel.
